Terms of Service

These Terms of Service ("Terms") are an agreement between you and ESA Card (esacard.com). They govern your use of our website, our registration service, and every product we sell. By using the site or placing an order, you accept these Terms. If you have questions before you agree, email support@esacard.com or call (888) 555-0134 — we answer in plain English.

1. What ESA Card is — and what it is not

ESA Card is an e-commerce registration service. We sell convenience credentials for emotional support animal owners: a digital Certificate of Registration, a wallet ID card, and a lifetime listing in our verification directory at esacard.com/verify. Registration takes about 3 minutes — pet details, a photo, and your name and city. There are no health questions, no evaluations, and no appointments, because we are not a healthcare provider and we do not offer any clinical service. We do not sell ESA letters or medical evaluations of any kind.

One more thing we say everywhere, because it is true: there is no official government ESA registry, and ours is a private service. Our ID cards, certificates, and verification listing — like everyone else's — are convenience items with no legal weight. The only document that matters under the Fair Housing Act and HUD's January 2020 Assistance Animals guidance is an ESA letter from a licensed mental health professional. 2. Eligibility

  • You must be at least 18 years old to use the service or place an order.
  • You must live in the United States; our products and shipping are U.S.-only.
  • You must provide accurate, truthful information during registration and at checkout. Your verification listing depends on what you tell us.

3. Your account

You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us right away at support@esacard.com if you suspect unauthorized use. We may suspend or close accounts used fraudulently or in violation of these Terms.

4. Prices and payment

Current prices are listed on our pricing page and at checkout. As of the date above: the Digital Kit is $39 (instant digital Certificate of Registration, digital wallet ID card, and lifetime verification listing) and the Complete Kit is $69 (everything in the Digital Kit plus a printed wallet card and printed certificate, shipped free by USPS in 3-5 days). Each kit covers up to 2 pets. Digital items are delivered instantly after payment.

Every ESA Card purchase is a one-time payment. We sell no subscriptions, and nothing renews automatically — your registration and verification listing last for the life of the animal at no additional charge. There are no renewal fees, ever. If a charge from us ever looks recurring, contact us immediately; that would be an error, and we will fix it.

5. Our guarantee

Two promises, both backed by our Refund Policy: a 30-day money-back guarantee on every kit — if you are unhappy for any reason within 30 days of purchase, we refund you in full. And if your printed card or certificate arrives damaged, or is later lost or damaged, we replace it free. The Refund Policy explains the details and controls if it conflicts with this summary.

6. No medical or legal advice

Content on esacard.com — including articles, state guides, and ESA law summaries — is general information, not medical or legal advice. Nothing on the site, and nothing we sell, creates a clinician-patient relationship. If you want an ESA letter, ask your own therapist or psychiatrist first, or use a legitimate telehealth service with clinicians licensed in your state. For advice about your specific situation, talk to a licensed clinician or attorney. If you are in crisis, call or text 988 (the Suicide & Crisis Lifeline) — do not wait on any website.

7. ESAs are not service animals

An emotional support animal is not a service animal under the Americans with Disabilities Act. An ESA letter supports housing accommodation requests under the Fair Housing Act; it does not grant access to restaurants, stores, or other public places. And since the Department of Transportation's December 2020 rule, U.S. airlines are not required to accept ESAs in the cabin — they treat them as pets. Do not present your ESA as a service animal; misrepresentation is illegal in many states.

8. Acceptable use

You agree not to:

  • Present your ESA Card certificate, ID card, or verification listing to a landlord, airline, business, or anyone else as if it were a legal document — it is not, and we say so on the products themselves
  • Provide false information during registration, including about an animal or its owner
  • Alter, forge, or resell any card or certificate we issue
  • Register an animal on behalf of someone else without their knowledge and consent
  • Scrape, copy, or republish site content, or interfere with the site's operation or security

We may refuse service, cancel orders, or remove verification listings obtained in violation of this section. Refunds in those cases are at our discretion.

9. Intellectual property

The ESA Card name, logo, site design, and content belong to ESA Card or our licensors. Your certificate and ID card are yours to use for the personal, honest purposes they are made for. Everything else on the site is licensed to you for personal, non-commercial use only.

10. Disclaimers and limitation of liability

The service is provided "as is." We work hard to keep the site accurate and available, but we do not warrant uninterrupted or error-free operation, and we do not warrant any particular outcome with a landlord, HOA, or housing provider — our products carry no legal force, and we cannot control how a third party behaves. To the fullest extent permitted by law, ESA Card's total liability for any claim arising from the service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect, incidental, or consequential damages. Some states do not allow these limits, so they may not fully apply to you.

11. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Your housing rights under the Fair Housing Act and your state's fair-housing law are unaffected — nothing here waives them.

12. Dispute resolution

Talk to us first. Before filing any formal claim, you agree to email support@esacard.com with a description of the dispute and give us 30 days to resolve it informally — most issues end here, usually with a refund under our Refund Policy. If we cannot resolve it within 30 days, either party may bring the claim in the state or federal courts located in Delaware, or in small claims court where you live if the claim qualifies.

13. Changes to these Terms

We may update these Terms as our service or the law changes. When we do, we will update the date at the top of this page, and for material changes we will email account holders before the new Terms take effect. Continuing to use the service after changes take effect means you accept them. Changes never apply retroactively to orders already placed.
