Everything below comes from the Fair Housing Act (42 U.S.C. § 3604(f)(3)(B)) as courts and state laws apply it.

- A request to waive pet fees, pet rent, and pet deposits, which many landlords grant for an assistance animal.
- An individualized review of your request; many landlords set aside blanket breed and weight rules for an assistance animal.
- Privacy: a housing provider is entitled to reliable documentation of the disability-related need, not your diagnosis or your medical records: the letter gives them the former without the latter.

The mechanics are simpler than the industry makes them look. You request an accommodation in writing; where your disability is not obvious, the housing provider may ask you to support the request, and the letter answers everything they are entitled to ask. A denial holds up only in narrow cases (a specific animal that poses a direct threat, or a genuine undue burden) never because “we don't accept those cards.” One recent change: HUD withdrew its 2020 assistance-animal guidance in 2025 and rescinded it for good in May 2026, so its enforcement arm no longer pursues these complaints. The Fair Housing Act itself, the courts that enforce it, and state fair-housing laws stand unchanged, and those are where these rights have always lived. State by state
Registration by state: the same kit in all fifty states
There is no separate California ESA registry or Texas ESA registry, so registering your animal with us works identically in all fifty states: the same certificate, the same wallet card, the same number anyone can check. What differs by state is the law around the letter, and there the differences are worth knowing.
California went first: AB 468 requires a 30-day provider–client relationship before a letter for an emotional support dog can be issued, a wait Arkansas has since matched for dogs, and Louisiana and Montana for any species, so a same-day letter does not meet the law in those four states. Iowa takes a different route: no waiting period, but the provider's written finding has to certify whether a provider–patient relationship of at least 30 days exists, in person or by telehealth, and Iowa findings expire after a year or the lease term, whichever is longer. Florida lets landlords request reliable documentation from a practitioner with personal knowledge of your condition, and made supplying fraudulent ESA documents a misdemeanor.
