Registering an Emotional Support Animal in Missouri

Missouri protects emotional support animals in housing and makes faking one a crime. Section 209.204 names emotional support animals as assistance animals, then lists what counts as misrepresenting one. Here's how that plays out in St. Louis, Kansas City, and Springfield.

Mo. Rev. Stat. § 213.040 (Missouri Human Rights Act)

Missouri's fair-housing law. Discrimination includes refusing reasonable accommodations in rules, policies, practices, or services when they are necessary for a person with a disability to use and enjoy a dwelling on equal terms. Complaints go to the Missouri Commission on Human Rights.

Mo. Rev. Stat. § 209.204

Missouri's misrepresentation law. Since August 2020 it covers assistance animals in housing, which it defines to include animals that provide emotional support. Knowingly misrepresenting an animal as an assistance animal, including false documents, a fake vest, or lying to a health care provider to get documentation, is a class C misdemeanor (class B on repeat) with civil liability for damages. Documentation must come from a qualified professional.

Fair Housing Act, 42 U.S.C. § 3601 et seq.

The federal law whose reasonable-accommodation duty courts have long read to cover emotional support animals.

Most states that police fake animals stop at service dogs in restaurants. Missouri went further. In 2020 it rewrote § 209.204, RSMo to cover assistance animals in housing, and it defined the term to include an animal "that provides emotional support that alleviates one or more identified effects of a person's disability." So Missouri law both recognizes emotional support animals by name and makes it a crime to fake one.

For an honest renter, that is good news: it makes a real letter worth more. Missouri is not one of the four states with a 30-day waiting law (California and Arkansas for emotional support dogs, Louisiana and Montana for any animal), and there is no state form. A qualified clinician who evaluates you can write the letter the same day.

Missouri law on emotional support animals

Your housing rights come from the Missouri Human Rights Act. Section 213.040, RSMo makes it discrimination to refuse reasonable accommodations in rules, policies, practices, or services when they are necessary for a person with a disability to use and enjoy a dwelling, mirroring the federal Fair Housing Act. A no-pets clause, a pet fee schedule, and a breed list are all rules, so a letter-backed request has to be considered. Complaints go to the Missouri Commission on Human Rights.

Section 209.204.3 is the other half. It says no one shall knowingly misrepresent any animal as an assistance animal to get housing accommodations under the FHA, and it lists examples: knowingly creating or handing over documents that falsely call an animal an assistance animal, putting an assistance-animal vest or sign on an animal that isn't one, and knowingly misstating material facts to a health care provider to get documentation. It also says all documentation for an assistance animal shall be from a qualified professional. A first violation is a class C misdemeanor, a repeat is class B, and the person is civilly liable for actual damages.

How to get an ESA letter in Missouri

  1. Ask the clinician who already treats you. A Missouri therapist, psychiatrist, or physician can often write the letter at a regular visit. Bring our free sample ESA letter so the format matches what landlords expect.
  2. No current provider? Choose a real evaluation. Telehealth services with Missouri-licensed clinicians typically charge $139–$199 and include a live appointment. Confirm a license you can look up and a license number on the finished letter.
  3. Tell the clinician the truth. § 209.204 makes knowingly misstating material facts to a health care provider to get documentation a misdemeanor. An honest evaluation is both the law and the letter that holds up.

What the letter changes at a Missouri leasing office

  • No-pet buildings must consider your request. Under § 213.040 and the FHA, a pet ban is not by itself a reason to refuse a reasonable accommodation.
  • Pet fees are often waived. Many landlords waive pet fees for an ESA with a clinician's letter; rules vary by state and building, so ask yours.
  • Breed and weight limits often bend. Many landlords set aside breed and weight limits for an ESA with a clinician's letter; rules vary by state and building, so ask yours.
  • Student housing and HOAs are covered too. Fair-housing duties reach associations and most apartments around Mizzou and the universities in St. Louis.
  • You still pay for damage. A waived pet fee doesn't waive responsibility for what your animal damages.

What a Missouri landlord can and can't ask

When your disability or need isn't obvious, a landlord may ask for your letter and confirm it's genuine, usually by checking the clinician's license. A landlord may not demand your diagnosis or medical records, require the animal to perform, or charge a fee to process the request. Denial is lawful only in narrow cases, such as a direct threat or substantial damage from your specific animal. If you are refused, answer in writing with the letter attached, cite § 213.040 and the FHA, and keep every reply; the Missouri Commission on Human Rights is the in-state place to file, and the federal FHA allows a private lawsuit within two years.

No Missouri ESA registry (and what a card is for)

Missouri keeps no ESA registry, and neither does the federal government. An ESA has housing rights, not public-access rights: it can't come into restaurants or stores the way a trained service dog can, and since early 2021 ESAs fly as pets under each airline's pet policy.
