NMSA 1978, § 28-1-7(G) (New Mexico Human Rights Act)

New Mexico's housing discrimination rule. No one may refuse to rent a housing accommodation, or set different terms, because of a physical or mental disability. Complaints go to the state's Human Rights Bureau within 300 days (§ 28-1-10).

Fair Housing Act, 42 U.S.C. § 3601 et seq.

The federal law whose reasonable-accommodation duty courts have long read to cover emotional support animals. In New Mexico it carries the accommodation request itself.

New Mexico renters range from Albuquerque apartments to student housing in Las Cruces and casitas in Santa Fe, and a no-pets clause turns up in all of them. A valid ESA letter changes the conversation. An emotional support animal is an accommodation request, not a pet, so a no-pets building still has to consider it, and many landlords waive pet fees for an ESA with a clinician's letter; rules vary by state and building, so ask yours.

New Mexico adds nothing to the letter itself. It is not one of the four states with a 30-day waiting law (California and Arkansas for emotional support dogs, Louisiana and Montana for any animal), there is no state form, and a licensed clinician who evaluates you can write your letter the same day.

New Mexico's Human Rights Act bars disability discrimination in housing

The state protection is § 28-1-7(G) of the New Mexico Human Rights Act. It makes it unlawful for anyone to refuse to rent you a housing accommodation, or to treat you differently in its terms, conditions, or privileges, because of a physical or mental disability. The act has no animal-specific section, so the request to keep an emotional support animal in a no-pets home runs through the federal Fair Housing Act, and a letter-backed request has to be evaluated on its own facts.

If a landlord refuses, the state route is a complaint to New Mexico's Human Rights Bureau, which investigates housing complaints as well as employment ones. It has to be filed within 300 days of the discriminatory act (§ 28-1-10), so keep the refusal in writing and note the date.

How to get an ESA letter in New Mexico

  1. Ask the clinician who already treats you. A New Mexico therapist, psychiatrist, nurse practitioner, or physician can often write the letter at a regular visit. Bring our free sample ESA letter so the format matches what property managers expect.
  2. No current provider? Get a real evaluation. Choose a clinician licensed in New Mexico who meets you live, by video or in person, and gives you a license number you can look up.
  3. Students: use the campus process. University of New Mexico and New Mexico State housing run their own accommodation requests, so send the letter in with your housing application.

Pair the letter with our instant registration kit: about 3 minutes at /register, pet details and a photo, never a health question, for a Certificate of Registration and a wallet ESA Card emailed as two print-ready documents.

What the letter changes at a New Mexico rental

  • No-pet buildings must consider your request. Under the FHA, a pet ban is not by itself a reason to refuse a reasonable accommodation.
  • Pet fees are often waived. Many landlords waive pet fees for an ESA with a clinician's letter; rules vary by state and building, so ask yours.
  • Breed and weight limits often bend. Many landlords set aside breed and weight limits for an ESA with a clinician's letter; rules vary by state and building, so ask yours.
  • Condos are covered too. Fair-housing duties reach condominium associations, not just traditional landlords.
  • You still pay for damage. A waived pet fee doesn't waive responsibility for what your animal damages.

What a New Mexico landlord can and can't ask

When your disability or need isn't obvious, a landlord may ask for your letter and confirm it's genuine, usually by checking the clinician's license. A landlord may not demand your diagnosis or medical records, require the animal to perform, or charge a fee to process the request, and has to evaluate your request individually rather than apply a blanket rule. If you are refused, answer in writing with the letter attached, cite NMSA § 28-1-7 and the FHA, and keep every reply. File with the Human Rights Bureau within 300 days, and the federal FHA allows a private lawsuit within two years.

No New Mexico ESA registry (and what a card is for)

New Mexico keeps no ESA registry, and neither does the federal government. An ESA has housing rights, not public-access rights: it can't come into restaurants or stores the way a trained service animal can, and since early 2021 ESAs fly as pets under each airline's pet policy.

The $39$59$79$99 Digital Kit covers one animal: a Certificate of Registration and a wallet ESA Card, sent as two print-ready documents, plus a listing at /verify, with a 30-day money-back guarantee. The $69$89$109$129 Complete Kit adds both in print, posted to US addresses; the pricing page compares the two.

New Mexico emotional support animal letter FAQs

Not a separate one. NMSA § 28-1-7(G) bars housing discrimination because of a physical or mental disability, and the federal Fair Housing Act supplies the reasonable-accommodation duty an ESA request relies on.
